General booking and contracting terms
Version for company review. Flagged commercial decisions must be resolved before real contracting is activated. The statutory rights described do not depend on that approval.
Who you contract with
Your contracting party is Operadora de Viajes y Turismo Tropical Caribbean Tour S.A.S., Colombian tax ID 900978684-1, at carrera 32 A no. 107B-48, Barranquilla, Atlántico, Colombia. Tourism registrations: RNT 96148, tour operator; RNT 243721, wholesaler. Traveller services and private agency distribution agreements are handled separately. These terms supplement your accepted proposal and cannot restrict mandatory legal rights.
Quotation, validity and confirmed services
Website descriptions are travel proposals. Your quotation must identify travellers, dates, itinerary, duration, accommodation and occupancy where relevant, transport, meals, guide, admissions, assistance, inclusions, exclusions, total price, taxes, currency, validity and booking conditions. Enquiries, baskets and messages do not hold availability. A booking requires written confirmation of available services and the agreed payment; payment alone does not establish confirmation by every supplier.
Reservations, deposits and balances
The retained commercial reference is a 30% deposit and balance 15 days before travel; requests within those 15 days require full payment after availability and terms are checked. A new company document proposes 50%, 72 hours and a balance three days before travel. That alternative awaits a decision and is not automatically adopted. Your accepted proposal must specify the applicable schedule. The two schedules are not combined and no new deadlines or charges are implied.
Prices, currencies and taxes
Your quotation must state the total, currency, taxes and mandatory charges, separately identifying optional extras. Confirmed own rates in COP, USD or EUR remain separate. Dated Google Finance conversions are indicative, not an official TRM or an independently confirmed USD or EUR price. Only the confirmed order determines the payable currency and amount. A contracted price cannot be changed unilaterally without a lawful basis or valid agreement. Agency net rates are private.
Availability, groups and minimum numbers
Dates, capacity and minimum numbers apply only when stated in the accepted proposal. A pricing basis is not available stock: quotation TCT-416 is based on 40 travellers. In Receptivos 2026, guide arrangements from four participants and a coordinator from seven apply only where specified. Groups of eight or more require an individual proposal. Any minimum must include a stated decision date and alternatives if it is not met. Unaccepted supplements cannot be charged.
Traveller and operational changes
Request changes in writing, quoting your booking. Availability, actual costs and previously disclosed conditions will be reviewed; a request is not a confirmed amendment. Operational changes and alternatives must be communicated, with express agreement where required. Force majeure may require essential adjustments, communicated as soon as possible. This does not create an unlimited right to change dates, hotels or services or reduce their quality without respecting traveller rights.
Cancellations and unused services
Submit a cancellation in writing. The calculation must identify services, recoverable amounts and previously disclosed deductions that are legally applicable. Third-party services are not automatically non-refundable. Historic percentages are retained in the commercial review record, subject to review before use. Cancellation exactly 30 days before travel remains unresolved; no default percentage is assigned. The new PDF also leaves a gap and does not automatically replace the earlier schedule. Withdrawal, payment reversal, agency non-performance and voluntary cancellation follow different rules.
No-show and early departure
A no-show does not trigger an automatic 100% charge here. Article 65 of Colombian Law 300 of 1996 and Decree 1074 of 2015, article 2.2.4.3.2.6, require review: they provide for 20% of the price or retention of a deposit or advance agreed in writing, as applicable. The relevant rules for each service must be checked. Illness, force majeure and early departure require individual assessment and an explained calculation. Penalties cannot defeat mandatory refund rights.
Refund procedure
Provide the booking reference, claimant, reason and supporting information through our contact channel. The agency must acknowledge the claim, assess its basis, explain the calculation and process any refund using the consumer’s preferred method under applicable law. A voucher cannot be imposed as the only remedy. Relevant tourism cases under Decree 1074, article 2.2.4.3.2.4, have the specified 30-calendar-day maximum; electronic-commerce cases covered by Law 2439 of 2024 have specific 15-calendar-day limits. Supplier delay does not justify extending statutory deadlines indefinitely.
Statutory withdrawal
For distance contracts, withdrawal is assessed under article 47 of Colombian Law 1480 of 2011. Where applicable, it must be exercised within five business days of concluding the service contract. Tourism services are not excluded as a whole; statutory exceptions, including services begun with the consumer’s agreement, must be checked. For electronic commerce, Law 2439 of 2024 provides a refund within 15 calendar days of exercising the right and meeting the relevant statutory information and return obligations. Specially regulated services require a separate assessment.
Payment reversal
For transactions and payment methods covered by article 51 of Law 1480 and Decree 587 of 2016, reversal may apply to fraud, unauthorised transactions, non-receipt, incorrect or defective services. Complain to the supplier and notify the payment-instrument issuer within five business days of becoming aware of the event or the legally relevant date, retaining evidence. Payment participants have the statutory 15-business-day processing period. This is not ordinary cancellation and does not guarantee a favourable decision. Never send full card numbers or security codes.
Suppliers, responsibilities and contingencies
The proposal identifies services organised or operated by the company and services supplied through third parties. Tropical Caribbean Tour remains responsible for its own information, selection, coordination and contractual duties; describing itself as an intermediary does not remove all responsibility. Flights, tickets and other components may follow special rules disclosed before acceptance. Weather, closures, safety events or force majeure require communication of alternatives and an assessment of affected services, preserving applicable refunds and rights. Unconfirmed community, health, immigration or access permissions are not guaranteed.
Documents, minors, assistance and accessibility
The agency advises on known itinerary requirements; travellers supply accurate information and valid documents and check their circumstances with the relevant authorities. Minors require applicable documents, supervision and permissions; do not enter their data in open forms. Discuss mobility, dietary or support needs before contracting so accessibility and alternatives can be checked with suppliers. Health information is sensitive and requires an agreed channel and appropriate authorisation. Confirm the assistance provider, coverage, exclusions and validity; included assistance is not unlimited insurance or a medical promise.
Privacy, responsible tourism and internal policies
Data needed for quotations, bookings, service delivery and claims is handled under the Data Protection Policy. Contract acceptance is not marketing consent or permission to publish personal images; those purposes need their own lawful treatment and authorisation. Applicable access, update and correction rights are preserved. Child protection and respect for communities, heritage and nature apply to operations. Workplace harassment, alcohol, drugs, smoking, management-system and process policies retain their corporate scope and do not replace traveller booking terms.
Order acceptance and payment
Before payment, you must be able to review and retain the order summary, services, amount, currency and specific conditions. Acceptance must be express, without pre-ticked boxes, and recorded against the order and terms version. A payment gateway processes payment; an approved status does not replace written booking confirmation. Browser-submitted amounts cannot change an order. Wompi retains its test configuration and PRIX its existing status. Electronic acceptance and order records require hosting verification before real contracting is enabled.
